CREDISENSE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We expressly disclaim all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the service will be uninterrupted, timely, secure, or error-free
- Any warranty regarding the accuracy, reliability, or completeness of analysis results
- Any warranty that defects will be corrected or that the service is free from viruses or harmful components
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREDISENSE, ITS CREATORS, OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to or alteration of your data
- Damages resulting from any reliance on information provided by Credivo
- Credit score changes, denied credit applications, or financial losses of any kind
- Errors, inaccuracies, or omissions in analysis results or recommendations
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED $100 USD OR THE AMOUNT YOU PAID TO USE THE SERVICE (IF ANY), WHICHEVER IS LESS. While we parse real credit report PDFs, results should be verified independently. Do not make financial decisions solely based on this tool. Always verify with official credit reports from AnnualCreditReport.com.
Indemnification
You agree to defend, indemnify, and hold harmless Credivo, its creators, operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of Credivo
- Your violation of these Terms of Service
- Your violation of any law or regulation
- Any dispute letters you send based on information from this service
- Any claims made by third parties related to your use of this service
- Your breach of any rights of another person or entity
Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Credivo shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.
Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class action, consolidated action, or representative action. You expressly waive your right to participate in a class action lawsuit or class-wide arbitration.
Jury Trial Waiver: You waive your right to a trial by jury for any disputes arising from these Terms or your use of Credivo.
Governing Law and Severability
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Terms Modifications
We reserve the right to modify these terms at any time. Continued use of Credivo after changes constitutes acceptance of the updated terms. We recommend reviewing these terms periodically.
